And any adult natural person placing an order on the www.lothaire.fr website, hereinafter "the Customer".

Article 1 — Purpose

These General Terms and Conditions of Sale govern the sale of products presented on the www.lothaire.fr website by the company Club Bis, in accordance with articles L. 111-1 et seq. of the Consumer Code. They define the mutual obligations of the parties as well as the various stages of the ordering process.

By validating their order, the Customer declares having read these General Terms and Conditions of Sale and accepts them without reservation.

These terms may be modified at any time. The terms applicable to an order are those in force on the site at the time it is placed.

Article 2 — Legal Capacity

The Customer declares to be of legal age and legally capable of entering into a contract.

Article 3 — Delivery Zones

Lothaire delivers in metropolitan France, the Principality of Monaco, countries of the European Union, and Switzerland.

Deliveries to overseas departments and territories, as well as to countries not mentioned above, are not provided at this time.

Article 4 — Price

Prices are indicated in euros, inclusive of all taxes, and are exclusive of delivery charges. The applicable VAT is that in force at the time of the order.

Lothaire reserves the right to modify its prices at any time. Products are invoiced at the rate in force at the time the order is validated.

For deliveries outside the European Union, particularly in Switzerland, customs duties and import taxes may be added to the price paid on the site. These amounts are set by the authorities of the destination country, requested from the recipient by the carrier upon delivery, and remain the responsibility of the Customer.

Article 5 — Products

The products presented on the site are offered within the limits of available stocks. In case of unavailability after the order is placed, Lothaire shall inform the Customer as soon as possible by email or telephone. The Customer may then choose another item or request the cancellation of their order and a full refund.

Lothaire describes the products with the greatest possible accuracy. The photographs illustrating the products do not form part of the contract; variations in color may appear depending on the screens. Lothaire's liability cannot be engaged in this regard.

Article 6 — Orders

The order is definitively validated when the Customer confirms their payment. They then accept the content of their order, the terms and delivery times, the prices, and these General Terms and Conditions of Sale.

Lothaire acknowledges receipt of the order by email.

Lothaire reserves the right to cancel or suspend the execution of an order in case of payment incident, impossibility of debiting the Customer's bank account, or in case of fraud or attempted fraud.

Article 7 — Payment

The Customer may pay for their order by credit card (Visa, Mastercard, American Express), Apple Pay, PayPal, or in installments at no extra cost via Klarna.

Bank transfers and cash on delivery are not accepted.

The amount is debited on the date of payment.

Article 8 — Delivery

8.1 Terms

Deliveries are made by Colissimo, Mondial Relay, or DHL Express, according to the method chosen by the Customer at the time of payment. Colissimo shipments are delivered against a signature.

Orders are prepared from Monday to Friday and shipped within 24 to 48 working hours. After shipping, the estimated time is 48 to 72 hours with Colissimo, 48 hours to a week with Mondial Relay, and 24 to 48 hours with DHL Express. Delivery times to the European Union and Switzerland are generally a few days longer.

These deadlines are given by the carriers for informational purposes. Under no circumstances may the delivery time exceed 30 days from the order.

No delivery is made to a PO box or general delivery address (poste restante).

Delivery to a Mondial Relay pick-up point is not offered for orders with an amount greater than €500, as the insurance coverage of this carrier is capped at this amount.

The Customer also has the possibility to collect their order for free in one of the Lothaire boutiques, by appointment, by choosing the "in-store pickup" option before payment.

8.2 Delivery Charges

Delivery charges depend on the destination country and are indicated to the Customer before the final validation of their order. They are detailed in the site's shipping policy.

8.3 Receipt

The Customer must check the condition of the package upon receipt. In case of damage or missing items, it is the customer's responsibility to issue handwritten reservations on the carrier's delivery slip, to confirm them to the carrier by registered letter with acknowledgment of receipt within three working days following delivery, and to inform Lothaire at service.client@lothaire.fr.

Any package not received must be reported to Lothaire within 30 days following the order date.

Article 9 — Right of Withdrawal

In accordance with articles L. 221-18 et seq. of the Consumer Code, the Customer has a period of fourteen (14) days from the receipt of their order to exercise their right of withdrawal, without having to justify their decision or pay any penalty.

To exercise this right, the Customer informs Lothaire of their decision via their customer account or by email to service.client@lothaire.fr. A standard withdrawal form is available on the site.

The Customer then has an additional fourteen (14) days to return the product to the following address:

Retours e-shop Lothaire
6 rue du Temple
33000 Bordeaux

Return costs are the responsibility of the Customer. It is recommended to ship the package with tracking and signature and to keep the proof of shipment until the full refund is received.

Products must be returned in their original condition, unworn, unwashed, with their tags attached, and in their original packaging. The Customer's liability may be engaged in case of depreciation of the product resulting from handling other than what is necessary to establish its nature and characteristics.

In accordance with article L. 221-28 of the Consumer Code, gift cards are not subject to a right of withdrawal.

Article 10 — Refund

Lothaire refunds the Customer at the latest fourteen (14) days from the date on which it is informed of the withdrawal decision. Lothaire may defer the refund until the product is recovered or until the Customer has provided proof of shipment, whichever comes first.

The refund is made via the payment method used during the order, unless the Customer expressly agrees to another method.

In case of withdrawal concerning the entire order, the initial delivery costs are also refunded, up to the amount of the standard delivery rate offered by Lothaire.

In case of payment in installments via Klarna, installments already paid are refunded and remaining installments are canceled.

Article 11 — Legal Guarantees

The products sold benefit, by law and without extra charge, independently of the right of withdrawal, from:

The legal guarantee of conformity, provided for in articles L. 217-3 et seq. of the Consumer Code. The Customer has a period of two years from the delivery of the goods to invoke it. They may choose between repair or replacement of the product, subject to the cost conditions provided for by article L. 217-12. If these solutions are impossible, disproportionate, or cannot be implemented within one month, the Customer may obtain the resolution of the contract and a refund of the price, or a price reduction. The Customer is exempt from providing proof of the lack of conformity during the twenty-four months following the delivery of the goods.

The legal guarantee against hidden defects, provided for in articles 1641 et seq. of the Civil Code. The Customer may then choose between the resolution of the sale and a price reduction, within a period of two years from the discovery of the defect.

These guarantees do not cover damage resulting from inappropriate use of the product, normal wear and tear, or failure to follow care instructions.

For any request under these guarantees, the Customer should contact customer service at service.client@lothaire.fr.

Article 12 — Customer Service

For any information or complaint, the Customer may contact customer service:

By email: service.client@lothaire.fr

Article 13 — Personal Data

In accordance with the General Data Protection Regulation and the Data Protection Act, the Customer has the right to access, rectify, erase, port, and object, which they can exercise by writing to service.client@lothaire.fr.

Article 14 — Intellectual Property

All elements of the www.lothaire.fr website — texts, photographs, logos, brands, layout — are protected by intellectual property law. Any reproduction, representation, or exploitation, in whole or in part, without prior written authorization from Club Bis, is prohibited.

Article 15 — Force Majeure

Lothaire's liability cannot be engaged in case of non-performance of its obligations resulting from a case of force majeure within the meaning of article 1218 of the Civil Code, particularly in case of fire, severe weather, accident, postal or transport strikes, or failure of communication networks. The Customer shall be informed as soon as possible and refunded if the order cannot be fulfilled.

Article 16 — Applicable Law and Dispute Resolution

These General Terms and Conditions of Sale are subject to French law.

In case of a dispute, the Customer should first contact Lothaire's customer service to seek an amicable solution.

Failing an agreement, the Customer may use a consumer mediator free of charge, in accordance with article L. 612-1 of the Consumer Code. The contact details of the mediator to which Lothaire adheres are as follows: [TO BE COMPLETED — name and contact details of the mediator].
